欢迎使用 Gainday（以下简称"本应用"）。本使用条款是您与 Gainday 运营方之间的法律协议。下载、安装或使用本应用即视为您已阅读并同意本条款。如不同意，请立即停止使用并删除本应用。
一、服务说明
Gainday 是一款为投资者设计的跨市场投资追踪 iOS 应用，主要功能包括：
- 多账户多货币持仓追踪
- 日美中港股、日本投信、加密货币等的行情显示
- NISA 额度计算与可视化
- 盈亏日历与统计图表
- 可选的 AI 对话分析（需要订阅）
- 价格告警与月度健康报告
二、非投资建议声明（重要）
本应用仅提供投资数据整理、计算、展示与信息整合服务，不构成任何投资建议、推荐、要约或邀请。AI 功能产出的内容仅供参考，不应被理解为投资咨询、金融建议或法律意见。
您的所有投资决策应基于自身的独立判断和专业顾问咨询。Gainday 不对您因依赖本应用内容做出的任何决策承担责任。
本应用在日本不从事金融商品取引法所规定的"投资咨询业"、"投资运用业"或相关金融业。在中国大陆不提供证券投资咨询业务。
三、账户与登录
- 核心功能无需注册即可使用
- 部分功能（AI 分析、订阅）需要通过 Apple Sign-In 登录
- 您需为您账户下的所有活动负责
- 请妥善保管您的 Apple ID；任何通过您 Apple ID 访问本应用的行为视为您本人的行为
四、订阅条款
4.1 订阅层级
本应用提供三档订阅：
- Free：免费永久，可用核心功能
- Gainday Pro：月付 / 年付，解锁 AI 对话（DeepSeek）、月度报告、无限告警、全部新闻
- Gainday Pro+：月付 / 年付，解锁 Claude 顶级模型、优先响应、高级扫盘（即将上线）
具体价格以 App Store 结账页面显示为准，可能因地区与促销而异。
4.2 付款与自动续订
- 订阅费用通过您的 Apple ID 账户扣除
- 除非在当前订阅期结束前至少 24 小时取消，否则订阅将自动续订
- 自动续订费用在当前订阅期结束前 24 小时内扣除
- 可随时通过 iOS 设置 → Apple ID → 订阅来管理或取消订阅
- 取消订阅后，当前订阅期内仍可继续使用付费功能，到期后自动降级为 Free
4.3 免费试用（如提供）
部分订阅层级可能提供免费试用期。若您在试用期结束前至少 24 小时未取消，订阅将自动转为付费并开始扣款。试用期内的使用条款与付费订阅相同。
4.4 退款
退款请求请直接向 Apple 提出：reportaproblem.apple.com。Gainday 本身无法处理 App Store 订阅的退款。
五、可接受使用
您承诺不会：
- 将本应用用于非法目的或违反当地金融法规的活动
- 反向工程、破解、修改或分发本应用
- 通过自动化手段批量抓取或滥用本应用的 API
- 冒充他人或使用他人 Apple ID
- 干扰或破坏本应用的基础设施（包括但不限于 DDoS、暴力登录）
- 使用本应用向他人提供收费的投资咨询服务
六、数据与隐私
您对自己输入的数据拥有完整所有权。我们如何处理您的数据详见《隐私政策》，两者共同构成我们的合同。
七、知识产权
本应用的代码、设计、logo、文档等均为 Gainday 运营方的财产，受著作权法保护。用户仅获得非独占、不可转让、可撤销的使用许可。
八、免责声明
- 本应用按"现状"和"可用"提供，不作任何明示或暗示保证
- 不保证数据准确、及时、完整。行情数据来自第三方（Yahoo Finance 等），可能存在延迟或错误
- 不对因服务中断、数据丢失、第三方服务故障造成的损失负责
- AI 输出内容可能包含错误、幻觉或偏见，使用前请自行核实
九、责任限制
在法律允许的最大范围内，Gainday 及其运营方对因使用或无法使用本应用而产生的直接、间接、附带、特殊、惩罚性损害（包括但不限于投资损失、数据丢失、商业中断）不承担责任。任何情况下，我们的累计责任不超过您在过去 12 个月支付给我们的订阅费用总和。
十、服务终止
我们保留在以下情况下随时暂停或终止您使用本应用的权利：
- 您违反本条款
- 您的使用可能损害其他用户或服务稳定性
- 法律或监管要求
您可随时通过删除 App 或发送邮件至 danaanwer@outlook.com 终止使用。
十一、条款变更
我们可能不时更新本条款。重大变更会在 App 内通知并在生效前 7 天邮件提醒。继续使用视为接受新条款。
十二、适用法律与管辖
本条款适用日本法律解释。因本条款产生的争议由东京地方法院管辖。若您所在地区有强制性消费者保护法律与本条款冲突，以当地法律为准。

Terms of Service
Welcome to Gainday (the "App"). These Terms of Service form a legal agreement between you and the Gainday operator. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, stop using and delete the App.
1. Service description
Gainday is an iOS application for cross-market investment tracking. Features include multi-account multi-currency holdings tracking, market data for Japan/US/China/HK/JP-funds/crypto, NISA quota visualization, P&L calendar and charts, optional AI chat analysis (paid), price alerts, and monthly health reports.
2. Not investment advice (important)
The App is a data aggregation, calculation, and visualization tool. Nothing in the App constitutes investment advice, recommendation, solicitation, or offer. AI-generated content is informational only and must not be interpreted as professional financial or legal advice.
All investment decisions are yours alone. Consult a licensed professional advisor. Gainday is not liable for decisions made in reliance on the App's content.
We do not engage in regulated investment advisory businesses under Japan's Financial Instruments and Exchange Act (金融商品取引法), mainland China's securities advisory rules, or equivalents.
3. Accounts
- Core features require no sign-in.
- AI features and subscriptions require Apple Sign-In.
- You are responsible for all activity under your account.
- Safeguard your Apple ID; actions taken with it are deemed yours.
4. Subscriptions
4.1 Tiers
- Free: forever, core features.
- Gainday Pro (monthly/yearly): AI chat via DeepSeek, monthly reports, unlimited alerts, full news feed.
- Gainday Pro+ (monthly/yearly): Claude top-tier model, priority response, advanced scanner (coming soon).
Prices shown at checkout in App Store are authoritative and may vary by region/promotion.
4.2 Payment & auto-renewal
- Charges go through your Apple ID.
- Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
- Renewal is charged within 24 hours before period end.
- Manage/cancel in iOS Settings → Apple ID → Subscriptions.
- After cancellation, paid features remain until current period ends, then downgrade to Free.
4.3 Free trials (if offered)
Some tiers may offer a free trial. If you do not cancel at least 24 hours before the trial ends, the subscription becomes paid automatically. Trial terms mirror paid subscription terms.
4.4 Refunds
Refund requests go directly to Apple at reportaproblem.apple.com. Gainday cannot process App Store refunds.
5. Acceptable use
You agree not to:
- Use the App for illegal purposes or in violation of local financial regulations.
- Reverse-engineer, crack, modify, or redistribute the App.
- Scrape or abuse our API via automation.
- Impersonate others or use someone else's Apple ID.
- Interfere with or disrupt our infrastructure (DDoS, credential stuffing, etc.).
- Use the App to provide paid advisory services to others.
6. Data & privacy
You own the data you input. How we handle data is detailed in the Privacy Policy, which is incorporated by reference.
7. Intellectual property
All code, design, logos, and documentation are the property of the Gainday operator and protected by copyright. You receive a non-exclusive, non-transferable, revocable license to use the App.
8. Disclaimer
- Provided "AS IS" and "AS AVAILABLE" without warranty of any kind.
- No guarantee of accuracy, timeliness, or completeness. Market data comes from third parties (Yahoo Finance, etc.) and may be delayed or erroneous.
- We are not liable for losses from service outages, data loss, or third-party failures.
- AI output may contain errors, hallucinations, or bias; verify before acting.
9. Limitation of liability
To the maximum extent permitted by law, Gainday and its operator are not liable for direct, indirect, incidental, special, or punitive damages (including investment losses, data loss, business interruption) arising from use or inability to use the App. In no event does cumulative liability exceed the total subscription fees you paid us in the preceding 12 months.
10. Termination
We may suspend or terminate your access if you violate these Terms, if your use risks harming other users or system stability, or as required by law. You may terminate anytime by deleting the App or emailing danaanwer@outlook.com.
11. Changes
We may update these Terms. Material changes will be announced in-app and via email at least 7 days before effective date. Continued use = acceptance.
12. Governing law & jurisdiction
These Terms are governed by the laws of Japan. Disputes are subject to the exclusive jurisdiction of Tokyo District Court. Mandatory local consumer protection laws in your region prevail where they conflict.

利用規約
Gainday（以下「本アプリ」）をご利用いただきありがとうございます。本規約は、あなたと Gainday 運営者との間の法的合意です。本アプリのダウンロード、インストールまたは利用をもって、本規約に同意したものとみなされます。同意されない場合は直ちに利用を中止し、本アプリを削除してください。
一、サービス概要
Gainday は投資家向けのクロスマーケット投資追跡 iOS アプリです。主な機能：複数口座・複数通貨の保有銘柄追跡、日米中港株・投信・仮想通貨の相場表示、NISA 枠可視化、損益カレンダーとチャート、任意の AI 対話分析（有料）、価格アラート、月次ヘルスレポート。
二、投資助言非該当の明示（重要）
本アプリはデータの整理、計算、可視化、情報集約を提供するものであり、いかなる投資助言、推奨、勧誘、申込みにも該当しません。AI が生成する内容は参考情報であり、専門的な金融助言または法的助言と解釈してはなりません。
投資判断はすべてユーザー自身の独立した判断と専門家への相談に基づいて行うものとします。Gainday は本アプリの内容に依拠してなされた判断について一切の責任を負いません。
当方は日本の金融商品取引法に基づく投資助言・代理業、投資運用業その他の金融業は一切行いません。
三、アカウントとログイン
- コア機能は登録不要で利用可能
- AI 機能およびサブスクリプションには Apple Sign-In が必要
- アカウント下のすべての行為はユーザーの責任
- Apple ID を適切に管理してください。その ID 経由でのアクセスはすべて本人の行為とみなします
四、サブスクリプション
4.1 プラン
- Free：恒久無料、コア機能利用可
- Gainday Pro（月額／年額）：DeepSeek AI 対話、月次レポート、無制限アラート、全ニュース
- Gainday Pro+（月額／年額）：Claude 最上位モデル、優先応答、高度スキャナ（近日）
価格は App Store 決済画面の表示を優先、地域・プロモーションにより変動する場合があります。
4.2 支払いと自動更新
- 利用料は Apple ID から引き落とし
- 現契約期間終了の少なくとも 24 時間前までに解約しない限り、自動更新されます
- 更新料は期間終了前 24 時間以内に課金
- iOS 設定 → Apple ID → サブスクリプションで管理・解約可能
- 解約後も現期間終了まで有料機能は利用可、その後 Free に降格
4.3 無料試用（提供時）
一部プランでは無料試用期間を提供する場合があります。試用期間終了の 24 時間前までに解約しない場合、自動的に有料サブスクに移行し課金が開始されます。試用期間中の規約は有料プランと同一です。
4.4 返金
返金は Apple に直接請求してください：reportaproblem.apple.com。App Store サブスクの返金は Gainday 側では処理できません。
五、許容される利用
以下の行為は禁止します：
- 違法目的または現地金融法規に違反する利用
- リバースエンジニアリング、解析、改変、再配布
- 自動化による API のスクレイピング・濫用
- 他人または他人の Apple ID の成りすまし
- インフラへの妨害（DDoS、総当たりログインなど）
- 本アプリを用いた有料の投資助言提供
六、データとプライバシー
入力データの所有権はユーザーに帰属します。データの取り扱いはプライバシーポリシーをご確認ください。両文書が合わせて当方との契約を構成します。
七、知的財産権
本アプリのコード、デザイン、ロゴ、ドキュメントなどはすべて Gainday 運営者の財産であり、著作権法により保護されます。ユーザーには非独占的、譲渡不可、取消可能な利用許諾のみ付与されます。
八、免責事項
- 「現状」「利用可能」ベースでの提供、明示・黙示の保証は一切なし
- データの正確性・適時性・完全性を保証しません。相場データは第三者（Yahoo Finance 等）由来で遅延・誤りの可能性あり
- サービス停止、データ消失、第三者サービス障害による損失について責任を負いません
- AI 出力は誤り、幻覚、バイアスを含む可能性があります。行動前に必ず確認してください
九、責任制限
法律で許される最大限の範囲で、Gainday およびその運営者は、本アプリの利用または利用不能から生じる直接的、間接的、付随的、特別または懲罰的損害（投資損失、データ消失、事業中断を含むがこれに限られない）について責任を負いません。いかなる場合も、累積責任はユーザーが過去 12 ヶ月に当方に支払ったサブスクリプション料の合計を超えません。
十、契約終了
本規約違反、他ユーザーやシステム安定性への損害リスク、法令要請がある場合、当方はいつでも利用を停止・終了できます。ユーザーはアプリ削除または danaanwer@outlook.com 宛メールでいつでも利用を終了できます。
十一、規約変更
本規約は随時更新される場合があります。重大な変更は、発効日の 7 日前までにアプリ内通知およびメールで告知します。継続利用は新規約への同意とみなします。
十二、準拠法と管轄
本規約は日本法に準拠します。本規約に関する紛争は東京地方裁判所を第一審の専属管轄とします。ただし、居住地の強行法規がある場合、当該法が優先します。
